1. DEFINITIONS
In these General Terms and Conditions, unless otherwise specified in the article, the following terms are understood to mean:
The definitions may be used in both singular and plural form without loss of meaning.
2. APPLICATION
2.1 These General Terms and Conditions apply to all Reservations and Agreements concerning the Accommodations rented out by My Rental Dream.
2.2 Agreements that deviate from these General Terms and Conditions are only valid if agreed upon in Writing by the Business User and My Rental Dream.
3. RESERVATIONS
3.1 Reservations can be made directly via the website https://www.myrentaldream.nl/ or by email at info@myrentaldream.com. Telephone reservations are not possible.
3.2 My Rental Dream reserves the right not to process Reservations made by individuals under 21 years of age.
3.3 My Rental Dream reserves the right to refuse Reservations without providing reasons or to impose additional conditions.
3.4 After the Tenant/Business User makes the Reservation, they will receive a reservation confirmation along with the accompanying invoice. The Tenant/Business User must check this immediately for accuracy and report any errors to My Rental Dream without delay. The Tenant/Business User remains responsible for any inaccuracies.
3.5 If the Tenant/Business User has not received a reservation confirmation with the accompanying invoice within five days of making the Reservation, they must contact My Rental Dream. Without the reservation confirmation/invoice, no claim can be made on the Reservation.
3.6 An Agreement is established between the Tenant/Business User and My Rental Dream when the Tenant/Business User makes a Reservation and My Rental Dream confirms the Reservation to the Tenant/Business User.
3.7 My Rental Dream informs the Tenant/Business User that the Reservation is legally binding. A right of withdrawal (14-day reflection period) does not apply to the Agreement concluded with My Rental Dream.
4. PRICES
4.1 The Tenant/Business User owes My Rental Dream the agreed Rental Price and Additional Costs as stated in the confirmation and invoice of the Reservation.
4.2 The Tenant/Business User can no longer use other discounts and/or special offers once the reservation confirmation and invoice have been sent by My Rental Dream.
4.3 All prices on the website include VAT, where applicable, unless stated otherwise.
4.4 My Rental Dream has the right to implement price increases resulting from interim changes in legal regulations (e.g., VAT rates, tourist tax, and levies) and pass these costs on to the Tenant/Business User.
5. CANCELLATION OR AMENDMENT OF THE AGREEMENT
5.1 A Reservation can be canceled free of charge up to 30 days before Arrival.
After that, the cancellation fees are as follows:
5.2 After cancellation, the Tenant/Business User will receive a cancellation confirmation detailing the cancellation costs.
5.3 In the event of a "No Show," the Reservation will be canceled, and the Tenant/Business User will not be entitled to a refund.
5.4 Changes to a Reservation are only possible based on availability and in agreement with My Rental Dream. The new Travel Sum will be settled with the old Travel Sum, and the Tenant/Business User will receive an additional (credit) note.
5.5 If My Rental Dream is required to make changes to the Tenant/Business User's Reservation due to circumstances (e.g., the period of stay or type/location of the Accommodation), My Rental Dream may offer the Tenant/Business User a suitable alternative.
6. SUBSTITUTION
6.1 The Tenant/Business User is not permitted to transfer the Accommodation to others, under any circumstances, unless agreed upon in advance in Writing with My Rental Dream.
6.2 If the Tenant/Business User and My Rental Dream have agreed in Writing to a substitution as mentioned in section 6.1, the Tenant/Business User remains jointly and severally liable with the substitute for the payment of the remaining portion of the Travel Sum.
7. OVERBOOKING
7.1 In the event of an overbooking by My Rental Dream, the Tenant/Business User will be informed as soon as possible.
7.2 My Rental Dream will offer the Tenant/Business User a suitable alternative Accommodation that is at least equivalent in type and price class. If no suitable alternative is available, the Tenant/Business User is entitled to a full refund of the Travel Sum.
7.3 My Rental Dream is not liable for any damage resulting from an overbooking.
8. DEPOSIT
8.1 My Rental Dream is entitled, upon first request, to require a Deposit. The Tenant/Business User must comply with this request and provide the Deposit.
9. PAYMENTS
9.1 The Tenant/Business User is required to pay the Travel Sum immediately when making a Reservation.
9.2 If upon Arrival it appears that the Travel Sum has not yet been (fully) credited to My Rental Dream’s bank account, the Tenant/Business User must pay the (remaining) amount before gaining access to the Accommodation. If it turns out that a payment was made but had not yet been credited to My Rental Dream's account at the time of Arrival, a refund will be issued afterward.
9.3 The Tenant/Business User is immediately in default after the payment term has expired. If payment is not made on time, My Rental Dream is entitled to terminate the Agreement. The Tenant/Business User will be liable for all costs and damages incurred by My Rental Dream as a result. My Rental Dream reserves the right to charge the full Travel Sum to the Tenant/Business User.
10. ARRIVAL AND DEPARTURE
10.1 The check-in and check-out times are stated in the reservation confirmation.
10.2 The Tenant/Business User can extend the Agreement with My Rental Dream for an additional fee, subject to availability and if My Rental Dream agrees in Writing. My Rental Dream is entitled to assign a different Accommodation for this purpose. The additional fee will be confirmed to the Tenant/Business User and must be paid immediately.
10.3 If the Tenant/Business User arrives late and/or departs early, the full Travel Sum for the entire Reservation remains payable.
10.4 The Tenant/Business User must inform My Rental Dream in advance if they arrive later than the check-in time stated for the Accommodation.
11. ACCESS
11.1 Access to the Accommodation is granted exclusively through the keys, access cards, codes, or other means provided by My Rental Dream, as stated in the reservation confirmation.
11.2 In case of loss of keys or other access means, the Tenant/Business User is liable for the replacement and/or repair costs of the security.
11.3 The Tenant/Business User must handle the provided access means carefully and ensure that unauthorized third parties do not gain access to the Accommodation.
12. REGULATIONS
12.1 The Tenant/Business User is required to behave as a responsible user concerning the Accommodation and the Facilities.
12.2 The Tenant/Business User must also adhere to the rules established by My Rental Dream, including the House Rules.
12.3 The Accommodation may only be occupied by the maximum number of persons stated on My Rental Dream's website, excluding children up to and including one year of age.
12.4 In the event of a violation of the rules in these General Terms and Conditions or the House Rules, My Rental Dream and its management have the right to immediately remove the Tenant/Business User without refunding any part of the Travel Sum.
12.5 If My Rental Dream has serious grounds to suspect that the Accommodation is being used in violation of the law and/or public order and/or morality, management has the right to access the Accommodation.
13. PETS
13.1 Pets are only allowed if expressly indicated and if they are specified at the time of making the Reservation. Adding a pet to an existing Reservation is only possible based on availability.
13.2 The Tenant/Business User is always liable for any damage or nuisance caused by the pet to the Accommodation and the premises.
13.3 Animals that may pose any danger to the environment are not allowed.
14. USE OF ACCOMMODATION; INVENTORY
14.1 The Tenant/Business User is jointly and severally liable for orderly behavior in and around the Accommodation.
14.2 The Tenant/Business User is jointly and severally liable for damage due to breakage, loss, or damage to the Inventory and/or Accommodation. Any damage must be reported immediately to My Rental Dream and/or management and paid for on the spot. If the Tenant/Business User can demonstrate that the damage is not their fault, the above does not apply.
14.3 Facilities, such as the infinity pool, may only be used under the conditions stated on the posted warning signs. Children may only use the swimming pool under the supervision or guidance of an adult.
15. ENVIRONMENTAL AWARENESS AND SUSTAINABILITY
15.1 The Tenant/Business User is expected to behave in an environmentally conscious manner during their stay in the Accommodation. This includes:
15.2 The Tenant/Business User is required to deposit waste in the designated containers and must not leave waste in or around the Accommodation.
16. FORCE MAJEURE AND LIABILITY
16.1 Force majeure on the part of My Rental Dream exists if My Rental Dream is wholly or partially, temporarily or permanently prevented from fulfilling the Agreement due to circumstances beyond its control, such as but not limited to war, strikes, blockades, fire, floods, epidemics, and other events.
16.2 If My Rental Dream is temporarily or permanently unable to fulfill the Agreement due to force majeure, My Rental Dream may propose an amendment to the Agreement. My Rental Dream will not be liable for any costs and/or damages to the Tenant/Business User.
16.3 The Tenant/Business User is not required to accept the proposed amendment. If the Tenant/Business User rejects it, they must notify My Rental Dream within 14 days of receiving the proposal. My Rental Dream is then entitled to terminate the Agreement immediately. The Tenant/Business User will then be entitled to a refund of (the already paid part of) the Travel Sum.
16.4 My Rental Dream is not liable for theft, loss, or damage of or to personal property of any kind during or as a result of the stay and use of the Accommodation, unless caused by intent or gross negligence on the part of My Rental Dream or its employees.
16.5 My Rental Dream is not liable for accidents, injuries, or fatalities in or around the Accommodation, including but not limited to the use of the available Facilities.
16.6 My Rental Dream accepts no liability for loss of enjoyment, such as but not limited to unexpected (construction) activities near the Accommodation, limited availability of Facilities, road works, noise nuisance from neighbors, church bells, fireworks, vehicles, trains, and/or agricultural machinery, or nuisance from pests in or around the Accommodation.
16.7 The Tenant/Business User is jointly and severally liable for any loss and/or damage to the rented Accommodation and/or other property of My Rental Dream caused during its use, regardless of who caused the damage.
16.8 My Rental Dream is not liable for additional planned activities by the Tenant/Business User made around the Reservation.
16.9 In cases of improper use or improper leaving of the Accommodation (e.g., excessive cleaning required), additional costs will be charged, which the Tenant/Business User must pay immediately.
16.10 My Rental Dream's potential liability to the Tenant/Business User is always limited to the Travel Sum, unless there is intentional or grossly negligent behavior.
17. DAMAGE CAUSED BY THIRD PARTIES
17.1 My Rental Dream is not liable for damage or inconvenience caused by other Tenants/Business Users, neighbors, or third parties in the vicinity of the Accommodation.
17.2 If damage to the rented Accommodation is caused by third parties, the Tenant/Business User must report this to My Rental Dream as soon as possible.
18. COMPLAINTS
18.1 The Tenant/Business User must report any complaints arising during the stay to My Rental Dream as soon as possible so that a suitable solution can be sought.
18.2 If the Tenant/Business User is no longer staying in the Accommodation or if the complaint has not been satisfactorily resolved, the Tenant/Business User may submit the complaint by email to info@myrentaldream.com, including the last name of the main booker, the email address used for the booking, phone number, reservation number, date of the complaint, description of the complaint, and the expected resolution.
18.3 The complaint must be submitted within one month after departure.
18.4 My Rental Dream will respond in writing within 7 days of receiving the complaint with a proposed solution. If a longer response time is needed, the Tenant/Business User will be informed.
19. SPECIFIC EXCLUSIONS
19.1 It is forbidden to organize events, parties, or commercial activities in the Accommodation without prior written permission from My Rental Dream.
19.2 Causing nuisance, including but not limited to noise, damage to My Rental Dream’s or third parties' property, or violating local laws and regulations, will result in immediate termination of the Agreement without any refund.
19.3 The Tenant/Business User must comply with specific conditions applicable to the Accommodation booked. These conditions may include additional restrictions such as smoking bans, limitations on the number of occupants, or pet policies.
20. PREMIUM SERVICES
20.1 Premium Services, for which My Rental Dream offers an information package, are not performed or booked by My Rental Dream itself. These services are booked directly with external parties. The information package provided by My Rental Dream contains only general information about the service and the contact details or website of the external provider.
20.2 My Rental Dream assumes no responsibility or liability for any events or circumstances arising from participation in or use of Premium Services. This includes, but is not limited to, incidents such as theft, accidents, personal injury, property damage, delays or cancellations.
20.3 It is the Customer's responsibility to carefully review and agree to all terms, conditions, liability provisions and rules of the applicable third party service provider prior to making a booking. Any questions, complaints or claims regarding Premium Services should be directed directly to the third party provider.
20.4 My Rental Dream offers the information packages as a service to its customers. My Rental Dream does not guarantee the completeness, accuracy or timeliness of the information provided. Customers should perform additional verifications independently.
20.5 By using the Premium Services and related information packages the customer fully indemnifies My Rental Dream from any liability, damage claims or legal action arising from the use of these services.
20. APPLICABLE LAW
20.1 Only Dutch law applies to the Agreement between the Tenant/Business User and My Rental Dream. Disputes concerning the Agreement may only be submitted to the competent court where My Rental Dream is established.
21. INSURANCE
21.1 My Rental Dream advises the Business User to take out travel, cancellation, or liability insurance to cover any risks of cancellation, damage, or loss.
21.2 The Business User’s liability for damage to the Accommodation or the Inventory cannot be covered by My Rental Dream. It is the Business User’s responsibility to insure this as needed.
22. TRAVEL DOCUMENTS
22.1 The Business User is responsible for possessing valid travel and identification documents, including mandatory business registrations or permits where applicable.
22.2 My Rental Dream accepts no liability for the consequences of not possessing the correct documents.
23. PRIVACY
23.1 By accepting the General Terms and Conditions, the Business User consents to My Rental Dream registering the company and personal data in its reservation system, in compliance with the General Data Protection Regulation (GDPR). More information can be found in our privacy statement.
23.2 At the request of the Business User, My Rental Dream will correct, delete, or block the data if it proves to be incorrect. Correcting or deleting data may, however, affect the services provided.
24. ACCURACY OF INFORMATION
24.1 My Rental Dream strives to present all information on its website and in its communications as completely and accurately as possible.
24.2 Obvious errors or inaccuracies, including price or typographical errors, are not binding on My Rental Dream. The Business User cannot derive any rights from incorrect information.
24.3 All business correspondence will preferably be sent digitally unless otherwise agreed.
25. FINAL PROVISIONS
25.1 If any provision of these General Terms and Conditions is declared invalid or unenforceable, the remaining provisions will remain in full force and effect.
25.2 My Rental Dream reserves the right to amend these General Terms and Conditions. The Tenant/Business User is deemed to accept the amended terms unless they submit a written objection within 14 days of receiving notification of the amendments.
25.3 The amended terms take effect from the moment they are communicated in Writing to the Tenant/Business User and/or are published on the Website.
